By using the Swap-bot.com website ("Swap-bot"), you are agreeing to be bound by the following terms and conditions. If you do not agree, do not use Swap-bot.

Overview:

Swap-bot facilitates swaps among the members of this service. You expressly agree that use of Swap-bot is at your own risk. You must be 18 years of age or older to use the Swap-bot service. Content posted to Swap-bot is solely the opinion and responsibility of the user posting the message. Swap-bot expects that all users will post respectful and courteous content. Swap-bot takes no responsibility and assumes no liability either for the content posted on the site, or for your communications and relationships with other Swap-bot members.

Privacy Policy:

Swap-bot views protection of users' privacy as a very important community principle. This section summarizes how your information is handled. Swap-bot stores and processes your information on computers located in the United States that are protected by physical as well as technological security devices. If you object to your information being used in this way please do not use Swap-bot's services.

Information we collect

• Account and swap information you provide: name, email address, postal address, profile content, swap participation and ratings.
• Content you post: listings, messages, comments, photos and other material you submit (see "Your Content" below).
• Technical information: IP address, device and browser type, pages viewed, and cookies or similar identifiers used for login, preferences, security, analytics and advertising.

How your information is shared

• To operate swaps (core function): when you join a swap, your name, email and postal address are shared with that swap's coordinator(s) and, once assigned, with your swap partner(s) so items can be sent. By joining a swap you authorize this sharing.
• Service providers: hosting, email delivery, analytics and security vendors that process data on our behalf and may not use it for their own purposes.
• Advertising: Swap-bot is supported in part by advertising, including Google AdSense. Ad providers may collect or receive cookie identifiers, IP addresses and device information to serve and measure ads. Where you have consented through our consent tool, ads may be personalized; otherwise non-personalized ads are served. Manage your choices at any time through our consent tool, Google's Ads Settings, or YourAdChoices.
• Legal and safety: where required by law, to enforce these Terms, or to protect the rights, safety or property of Swap-bot, its users or the public.

We do not sell your personal information for money. Note that personalized advertising may be treated as a "sale" or "sharing" of personal information under California and certain other U.S. state privacy laws; the opt-out mechanisms above (consent tool, Google's Ads Settings, YourAdChoices) are how you exercise that choice.

Your choices and rights

• You may request access to, correction of, or deletion of your personal information by emailing rachel [at] swap-bot.com. We respond within a reasonable time and no later than required by applicable law.
• Residents of the EU/UK have the rights of access, rectification, erasure, restriction, portability and objection under applicable data protection law; residents of California and certain other U.S. states have rights to know, delete, correct and opt out of sale/sharing of personal information, and to non-discrimination for exercising them.
• Cookies: most browsers let you block or delete cookies, but parts of Swap-bot (including login) will not function without them.

General Terms

• You must be 18 years and older to use this site. You are responsible for any activity that occurs under your username.
• You are responsible for keeping your password secure.
• You must not abuse, harass, threaten, impersonate or intimidate other Swap-bot users.
• You may not use the Swap-bot service for any illegal or unauthorized purpose. Users agree to comply with all local laws regarding online conduct and acceptable content.
• You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links that you submit, post and display on the Swap-bot site.
• You must not modify, adapt or hack Swap-bot.com or modify another website so as to falsely imply that it is associated with Swap-bot.
• You must not create or submit unwanted email or Spam to other Swap-bot members.
• You must not transmit any worms or viruses or any code of a destructive nature.
• You must not, in the use of Swap-bot, violate any laws in your jurisdiction.

Violation of any of these agreements will result in the termination of your Swap-bot account. While Swap-bot prohibits such conduct and content on its site, you understand and agree that Swap-bot is a venue and as such is not responsible for the content posted on its web site and you nonetheless may be exposed to such materials and that you use the Swap-bot service at your own risk.

Your Content; Copyright (DMCA)

By uploading images or otherwise posting content to Swap-bot, you grant Swap-bot a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce and distribute that content on and in connection with the Swap-bot service, including through service providers (such as hosting and content-delivery vendors) acting on our behalf. This license ends when you delete the content or your account, except for copies retained in backups or as required by law. You agree to allow other Swap-bot users to view content you make visible through the service.

You represent and warrant that you own or have the rights to post the content you submit, and that it does not infringe the copyright, trademark, privacy or other rights of any person. Do not post copyrighted material (including images, text or patterns) without the permission of the copyright owner.

Swap-bot respects the intellectual property of others. It is our policy to remove content that infringes copyright and to terminate, in appropriate circumstances, the accounts of repeat infringers. To notify us of claimed infringement, send a notice to Swap-bot DMCA Agent, 285 5th Ave PMB 415, Brooklyn, NY 11215, or email rachel [at] swap-bot.com with subject "DMCA Notice", containing: (1) identification of the copyrighted work; (2) identification of the infringing material and its location on Swap-bot; (3) your contact information; (4) a statement of good-faith belief that the use is unauthorized; (5) a statement, under penalty of perjury, that the information is accurate and you are authorized to act; and (6) your physical or electronic signature. If your content was removed by mistake, you may send a counter-notice with the same contact information, identification of the removed material, and your consent to the jurisdiction of the federal courts where you (or Swap-bot, if you are outside the U.S.) are located.

General Conditions

• Swap-bot reserves the right to modify or terminate the Swap-bot service for any reason, without notice at any time.
• Swap-bot reserves the right to alter these Terms of Use at any time.
• Swap-bot reserves the right to refuse service to anyone for any reason at any time.
• Swap-bot may, but has no obligation to, remove content and accounts containing content that Swap-bot determines in Swap-bot's sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property, or the Swap-bot Terms of Use and Privacy Policy.
• Swap-bot allows only one account per individual. You agree to hold only one Swap-bot account and to not misrepresent your identity.

You must agree with and accept all of the terms and conditions contained the Terms of Use, the Privacy Policy, the DOs and DON'Ts of Swap-bot, and other policy documents and community guidelines as posted on Swap-bot before you may become a member of Swap-bot.

Changes to these Terms

Swap-bot may amend the Terms of Use and any other policy documents and community guidelines by posting the amended terms on Swap-bot with a new "Last updated" date. Material changes take effect 30 days after posting (or later if stated); your continued use of Swap-bot after the effective date constitutes acceptance. If you do not agree to amended terms, stop using Swap-bot and you may request account deletion at rachel [at] swap-bot.com.

Advertising

Swap-bot displays third-party advertisements. Advertisers — not Swap-bot — are solely responsible for ad content, and advertising on Swap-bot is not an endorsement by Swap-bot of any advertiser, product or claim. Personalized advertising is subject to your consent choices (see Privacy Policy above).

Membership Eligibility

Swap-bot is a service and venue where all adult people (over the age of 18) are welcome to participate. We are committed to a policy of nondiscrimination for all persons regardless of race, sex, color, religion, creed, national origin or ancestry, marital status, sexual orientation, or disability. We encourage all of our coordinators to adopt a similar policy when regulating their swaps. Swap-bot's services are not available to children (persons under the age of 18) or to temporarily or indefinitely suspended Swap-bot members. If we learn that a member is under 18, we will terminate the account and delete associated personal information.

Fees and Services

Joining Swap-bot and swapping on Swap-bot is free. Swap-bot is supported in part by advertising (see "Advertising" above).

Identity Verification

Swap-bot uses many techniques to verify the accuracy of the information Swap-bot's users provide to Swap-bot when they register on Swap-bot. However, because user verification on the Internet is difficult, Swap-bot cannot and does not confirm each user's purported identity. Thus, Swap-bot has established a user-initiated rating system to help you evaluate with whom you are dealing. Swap-bot also encourages you to communicate directly with your swap coordinators and partners through the tools available on Swap-bot.

Release

Because Swap-bot is a venue, in the event that you have a dispute with one or more users, you release Swap-bot (and Swap-bot's officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you expressly waive California Civil Code § 1542, which provides: "A general release does not extend to claims that the releasing party or releasor does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the releasee."

Information Control

Swap-bot does not control the information provided by other users that is made available through our system. You may find other users' information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using Swap-bot. Please note that there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals. By using Swap-bot, you agree to accept such risks and that Swap-bot (and our officers, directors, agents, subsidiaries, joint ventures and employees) is not responsible for any and all acts or omissions of users on Swap-bot

Swap Coordinators

Swap coordinators have access to the contact information of all swappers who participate in their swaps. We require that coordinators use this information responsibly and with discretion. Swap coordinators and members are not allowed to publish the contact information of other members in an online public area.

Rating System

Integrity: You may not take any actions that may undermine the integrity of the rating system. If you earn a low percentage rating, your account may be flagged for staff review, at which time your account may be fully or partially suspended.

Export: You acknowledge that your feedback consists of comments left by other users and a composite rating number compiled by Swap-bot. Further, you acknowledge that the composite number, without the feedback comments, does not convey your full user reputation. Because feedback ratings are not designed for any purpose other than for facilitating transactions between Swap-bot users, you agree that you shall not market or export your Swap-bot feedback rating in any venue other than the Swap-bot operated website.

Import: Swap-bot does not provide you with the technical ability to import feedback from other (non-Swap-bot operated) websites to Swap-bot because a composite number, without the corresponding feedback does not reflect your true online reputation within our community.

Breach (Breaking the Rules)

Without limiting other remedies available, Swap-bot may, without prior notice, limit your activity, immediately remove you from swaps, warn Swap-bot's community of your actions, issue a warning, temporarily suspend, indefinitely suspend or terminate your account and refuse to provide our services to you if:

• you breach this Terms of Use, the Privacy Policy, or other policy documents and community guidelines;
• Swap-bot is unable to verify or authenticate any of your contact information; or
• Swap-bot believes that your actions may cause financial loss or legal liability for you, Swap-bot's users or Swap-bot.

Disclaimers; Liability Limit

Swap-bot provides the service "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Swap-bot does not warrant that the service will be uninterrupted, error-free or secure, or that user content is accurate or lawful.

In no event shall Swap-bot, and (as applicable) Swap-bot subsidiaries, officers, directors, employees, or suppliers be liable for lost profits or any special, incidental, or consequential damages arising out of or in connection with our site, our services, or this agreement (however arising, including negligence). To the maximum extent permitted by law, Swap-bot's total liability for all claims arising out of or relating to the service or this agreement shall not exceed the greater of (a) the amounts you paid to Swap-bot in the 12 months before the claim arose or (b) one hundred U.S. dollars (USD $100). Some jurisdictions do not allow the exclusion of implied warranties or the limitation of certain damages, so portions of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Swap-bot and its officers, directors, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the service, your content, or your violation of these Terms or of any law or third-party right.

Legal Compliance

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service.

Governing Law; Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service shall be brought exclusively in the state or federal courts located in Kings County, New York, and you consent to their personal jurisdiction.

General Legal Provisions

If any provision of these Terms is held unenforceable, the remaining provisions continue in full force, and the unenforceable provision is modified to the minimum extent necessary to make it enforceable. Swap-bot's failure to enforce any provision is not a waiver of its right to do so later. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and community guidelines referenced here, are the entire agreement between you and Swap-bot regarding the service.

Resolution of Disputes

Swap-bot's goal is to make you happy. In the event a dispute arises between you and Swap-bot, please email Rachel Johnson at rachel [at] swap-bot.com and we will work quickly towards a solution. We encourage you to report all user-to-user disputes to your local law enforcement, postmaster general, or a certified mediation or arbitration entity.
